Introduction
Welcome to Disco Chess. These Terms and Conditions ("Terms") govern your use of our website and mobile applications and the services we provide through them (collectively, the "Service"), as well as the purchase of any paid subscription. They cover both your use of the Service and the terms on which we sell subscriptions to you.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service. These Terms are provided in the English language only.
Definitions
In these Terms:
- "Disco Chess", "we", "us", and "our" mean MB Ordinary Ventures, the operator of the Service (see "Information About Us" below).
- "Service" means the Disco Chess website, mobile applications, and related features and content.
- "Account" means the account you create to access certain features of the Service.
- "Content" means all text, graphics, logos, images, software, and puzzles made available through the Service.
- "Premium" or "Paid Content" means the paid features and content that can be accessed through a Subscription or otherwise earned.
- "Subscription" means a recurring paid plan giving you access to Premium.
- "Hearts" means the virtual items that govern your ability to use certain features.
- "Consumer" means an individual using the Service for purposes that are wholly or mainly outside their trade, business, craft, or profession.

The Service is operated by MB Ordinary Ventures, a company registered in the Republic of Lithuania under company code 307541958, with its registered office at Eduardo André g. 14-5, Vilnius, LT-02232, Lithuania. Our VAT (PVM) number is LT100020339915.

Eligibility and Consumers Only
You must be at least 16 years old to use the Service.
By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
The Service is provided to Consumers for personal, non-commercial use. It is not intended for use in the course of a business, and any business use is not covered by these Terms.
Account Registration
To access certain features of the Service, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate and current
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
Username and Public Profile
Your account includes a unique username that identifies your public profile. You agree to:
- Choose a username that is 3-20 characters long, containing only letters, numbers, hyphens, and underscores, and starting with a letter or number
- Not choose a username that impersonates another person, brand, or organization
- Not choose a username that is offensive, vulgar, or violates the rights of others
- Not choose a username that is confusingly similar to official Disco Chess accounts or reserved terms (e.g., admin, support, help)
- Accept that your public profile, including your username, display name, profile photo, training statistics (puzzles solved, time trained, streak), and activity history, will be publicly visible to anyone who views your profile page
We reserve the right to reclaim, remove, or change any username at our sole discretion, including usernames that violate these Terms, infringe on trademarks, or are inactive for an extended period.
Use of the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Use any automated means (including bots, scripts, or scrapers) to access the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove, obscure, or alter any legal notices displayed on the Service
- Use the Service to transmit viruses, malware, or other harmful code
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Harass, abuse, or harm another person through the Service
- Create multiple accounts or use the Service to abuse any referral, invite, or promotional systems
- Share, sell, transfer, or allow others to access your account
- Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service
Fair Use
We reserve the right to implement rate limiting, usage restrictions, or other technical measures to ensure fair access to the Service for all users. Excessive or abusive usage patterns may result in temporary or permanent restrictions on your account.
No Scraping, Data Mining, or AI Training
You may not scrape, harvest, or carry out text or data mining on the Service or its Content, nor use the Service or its Content to develop or train any machine learning or artificial intelligence model, without our express prior written permission. We expressly reserve our rights in this respect.
Objectionable Content and Moderation
We have zero tolerance for objectionable content and abusive behavior, including harassment, hate speech, threats, and offensive usernames or display names. You can report objectionable content or users by emailing [email protected], and in our mobile apps you can report or block a user directly from their profile or the leaderboard. We review reports and act on them promptly, typically within 24 hours, and we may remove content or suspend or terminate accounts that violate these Terms.
Nature of the Service and No Guaranteed Results
Disco Chess is a training tool designed to help you practise and improve your chess. While we build the Service to be effective, chess improvement depends on many factors that are personal to you, including the time and effort you invest. We do not warrant or guarantee any particular result, rating gain, or other outcome from your use of the Service.
Premium Features and Invite System
The Service may offer premium features or benefits ("Premium") that can be earned through our invite system or other methods we may introduce from time to time.
You acknowledge and agree that:
- Premium access is a revocable privilege, not a guaranteed right
- We reserve the right to modify, suspend, or discontinue Premium features at any time without notice
- We may change the criteria for earning or maintaining Premium access at our sole discretion
- Premium benefits may not be sold, transferred, or exchanged for monetary value
- Abuse of the invite or referral system, including but not limited to creating fake accounts or engaging in fraudulent referral activities, may result in immediate termination of your account and forfeiture of all Premium benefits
- We reserve the right to verify the legitimacy of any referrals and revoke Premium access obtained through illegitimate means
Virtual Items
The Service may include virtual items such as hearts or other in-game mechanics that govern your ability to use certain features. You acknowledge and agree that:
- Virtual items have no monetary value and cannot be exchanged for real currency
- Virtual items are not your property and we retain all rights to them
- We may modify the mechanics, regeneration timing, or availability of virtual items at any time
- Virtual items may not be transferred, sold, or traded
- Upon termination of your account, you will lose all virtual items with no compensation
Rewarded Advertisements
The Service may offer you the option to watch video advertisements to earn in-game rewards, such as hearts. By choosing to watch ads, you acknowledge and agree that:
- Watching ads is entirely optional and not required to use the Service
- Rewards are granted only for completing full video views; partial views do not qualify for rewards
- We may modify, suspend, or discontinue rewarded ads at any time without notice
- We are not responsible for the content of third-party advertisements
- Ad availability may vary based on your location, device, and other factors
- Attempting to manipulate or abuse the rewarded ad system (including using ad blockers, automation, or other circumvention techniques) may result in account suspension or termination
- Rewards earned through ads are subject to the same terms as other virtual items and have no monetary value
Paid Subscriptions
Premium access may also be obtained through paid subscriptions. If you choose to purchase a subscription, the following terms apply.
Subscription Terms, Pricing and Availability
- Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your chosen plan)
- Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date
- The subscription fee will be charged to your chosen payment method at the time of purchase and upon each renewal
- Prices are displayed in Euros (EUR) and include applicable taxes (VAT / PVM)
- We reserve the right to change subscription prices from time to time. Any price change will not affect a subscription you have already purchased but will apply to subsequent renewals. We will give you advance notice before a price change takes effect, and if you do not agree to it you may cancel before your next renewal date
- We may make minor changes to Premium to reflect changes in law or to address technical or security issues. Where we make a more significant change that affects your use of Premium, we will give you notice
How the Subscription Contract Is Formed
When you purchase a subscription on our website, a binding contract is formed when your payment is confirmed at checkout by our payment processor, Stripe. We will make the details of your subscription available to you through your account.
Your Right to Cancel (14-Day Withdrawal)
As a consumer, you generally have a right to withdraw from a distance purchase within 14 days. Because a subscription gives you immediate access to digital content, when you purchase and begin accessing Premium you expressly request that we start providing it immediately and you acknowledge that you will lose your right of withdrawal once access has begun. To the extent access has not yet begun, you may withdraw within 14 days by contacting us at [email protected].
Cancellation and Renewal
You may cancel your subscription at any time through the Stripe Billing Portal accessible from your account preferences. Upon cancellation:
- You will retain access to Premium features until the end of your current billing period
- Your subscription will not renew after the current period ends
- No partial refunds are provided for unused time within a billing period, except where required by law
Your Other Rights to End the Contract
You may also end your subscription and receive a refund for any unused, prepaid part of it if: we tell you about a significant change to Premium or these Terms that you do not agree to; we suspend or notify you that we are going to suspend Premium for a prolonged period for reasons within our control; or we are otherwise in material breach of these Terms.
Refunds
Refunds for subscription payments are handled in accordance with our Complaints Policy, and without prejudice to your statutory rights as a consumer. In general:
- Refund requests must be submitted within 14 days of the initial purchase or renewal
- Refunds are provided at our discretion and may be subject to verification
- Chargebacks or disputed payments may result in immediate suspension of your account and Premium access
Payment Processing
If you make any purchases through the Service, you agree to provide accurate and complete payment information.
All payments are processed securely through Stripe, our third-party payment processor. By purchasing a subscription, you agree to Stripe's Terms of Service. We do not store your full payment card details; this information is handled entirely by Stripe in accordance with PCI DSS requirements.
Digital Content Quality and Conformity
We provide Premium with reasonable skill and care and in conformity with its description. If digital content we supply is faulty or not as described, you are entitled to the remedies available to consumers under applicable European Union and Lithuanian law, which may include having the content brought into conformity, an appropriate reduction in price, or a refund. If defective digital content damages a device or other digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation, as provided by applicable law.
Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, images, software, and puzzles, are owned by Disco Chess or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
Third-Party Services
The Service may contain links to, or integrate with, third-party websites or services that are not owned or controlled by Disco Chess, including chess platforms you choose to link (such as Lichess), our payment processors, advertising partners, and analytics providers. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party services.
Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, including but not limited to:
- Adding, removing, or modifying features or functionality
- Changing the availability, mechanics, or rules of puzzles or game elements
- Introducing new features, including experimental or beta features
- Performing scheduled or emergency maintenance
Except as set out in "Your Other Rights to End the Contract" above and your statutory rights, we will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. Service interruptions, including during maintenance, do not extend or compensate for any time-limited benefits or features.
Viruses, Malware, and Security
You must not misuse the Service by knowingly introducing viruses, trojans, worms, or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Service, the server on which it is stored, or any server, computer, or database connected to it. Doing so may be a criminal offence under applicable law, and we will report any such breach to the relevant authorities and cooperate with them.
Disclaimers
Except for the rights you have as a consumer under applicable law, and to the extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- Any errors in the Service will be corrected
Limitation of Liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including our liability for death or personal injury caused by our negligence, for fraud, or for any matter for which it would be unlawful to exclude or limit liability. Nothing in these Terms affects your statutory rights as a consumer.
Subject to the paragraph above, and to the maximum extent permitted by law, Disco Chess shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
Indemnification
You agree to indemnify, defend, and hold harmless Disco Chess and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
Communications from Us
We may send you messages relating to your account and the Service, including service updates, security notifications, and transaction confirmations, and, on mobile, push notifications where you have enabled them. We send marketing emails only with your consent or where otherwise permitted by law, and you can opt out at any time through your account settings or by using the unsubscribe link. How we handle your personal data is explained in our Privacy Policy.
Privacy
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy and Cookies Policy to understand how we collect, use, and protect your personal information.
Complaints and Feedback
If something has fallen short of your expectations, please tell us at [email protected] so we can put it right. Our full process is set out in our Complaints Policy. As a consumer, you may also contact the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba, VVTAT) in Lithuania if we are unable to resolve your complaint.
Account Deletion
You may delete your account at any time through your account preferences or by contacting us at [email protected].
Account deletion is permanent and cannot be undone. When you delete your account:
- All your personal data, including your profile information, will be permanently deleted
- All your progress, including cycles completed, puzzles solved, and statistics, will be permanently deleted
- Your hot streak data and activity history will be permanently deleted
- Any active Premium subscriptions will be cancelled
- All virtual items (hearts, etc.) will be forfeited without compensation
- You will immediately lose access to the Service
We may retain certain data for legal compliance, fraud prevention, or as required by law, but this data will be anonymized and not linked to your identity.
Termination and Suspension
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason or no reason, including if we believe you have violated these Terms.
In the event of suspension or termination by us:
- We may immediately disable your account and access to the Service
- You will forfeit all Premium benefits, virtual items, and progress without compensation
- We reserve the right to delete your account data, including but not limited to puzzle progress, statistics, and any other account information
- Where we terminate for a serious or repeated breach of these Terms, our decision is final, though this does not affect your statutory rights or your ability to complain
- You may not create a new account without our express written permission if your previous account was terminated for violating these Terms
Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.
Transfer of This Agreement
We may transfer our rights and obligations under these Terms to another organisation, for example if our business is sold. Any such transfer will not affect your rights under these Terms. You may not transfer your rights or obligations under these Terms to anyone else without our prior written consent.
Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of these Terms and, in some cases, we may provide additional notice (such as adding a statement to our homepage or sending you a notification).
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions. As a consumer, you also benefit from any mandatory provisions of the law of the country in which you are resident, and nothing in these Terms affects your rights under those mandatory provisions.
Any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts of Lithuania, without prejudice to any right you may have as a consumer to bring proceedings in the courts of your country of residence.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
No Waiver
If we do not insist that you perform any of your obligations under these Terms, or if we delay in taking steps against you in respect of a breach, that will not mean that we have waived our rights against you or that you do not have to comply with those obligations.
Entire Agreement
These Terms, together with our Privacy Policy, Cookies Policy, Complaints Policy, and any other legal notices published on the Service, constitute the entire agreement between you and Disco Chess regarding your use of the Service.
